Audit Protection

Engineered to be defensible.

Audit Protection is built into every Prosperity Tax Advisors engagement, not sold separately after the fact. It means contemporaneous documentation, memos citing the relevant statutes, and representation from the same CPAs and Enrolled Agents who built your strategy if a notice arrives. The goal is a position that holds up the same in review as on paper.

Audit protection is not an add-on we sell at checkout. It is a pillar of how we build. Every strategy is documented to hold up under review from the day it is implemented.

Built in. Not bolted on.

A Pillar, Not An Add-On

This is the Authentication step, made visible.

Step five of the Prosperity Process: Authentication. Documented to the standard a reviewer expects.

Most audit defense products are sold after the fact. A policy you buy in case the return you already filed gets pulled. By then the documentation is whatever was kept along the way, and the position is whatever the preparer chose without a defense file behind it.

We work the other direction. The defense file is built while the architecture is built. The memos are written while the elections are filed. The substantiation is captured while the transactions happen, not reconstructed under pressure twelve months later.

The result is calm, not anxiety. You know the file holds up because you watched it being built that way.

What That Looks Like

Three disciplines, applied to every engagement.

01

Audit-ready documentation

Every position we take is supported by contemporaneous memos, elections, calculations, and source documents, organized so a reviewer can follow our reasoning without us in the room.

02

Credentialed representation

If a notice or examination arrives, you are represented by the same CPAs and Enrolled Agents who designed the architecture. Not a stranger reading the file for the first time.

03

Defensible by design

Strategies are selected and implemented to the standard a reviewer expects. We do not chase aggressive positions for a marginal benefit when a cleaner, well-supported one is available.

The Distinction

Efficient vs. Defensible.

Almost any strategy can be made to look efficient on a spreadsheet. Far fewer hold up when a reviewer asks for the file. We build for both, and we will not trade the second for the first.

Efficient (Only)

Optimized on the page

Numbers that work in a model, with thin support behind them.

  • Aggressive positions chosen for headline savings
  • Documentation reconstructed after the fact
  • Strategy that depends on not being looked at
  • Defense plan introduced only if a notice arrives

Efficient AND Defensible

Engineered to hold

Numbers that work in a model, with a file that holds up if the model is questioned.

  • Positions selected within well-established authority
  • Documentation captured contemporaneously, not retroactively
  • Strategy that performs the same in a review as on paper
  • Defense file built during implementation, ready from day one

The File We Keep

What is in the defense packet.

Every active client has a current defense file. It travels with the engagement. If a question arrives, we open it. If one does not, it quietly does its job in the background.

  • Tax position memos with citation to statute, regulation, and ruling
  • Elections, designations, and filings retained in a single client record
  • Substantiation logs for time, mileage, materials, and home office
  • Reasonable compensation analysis for closely-held entities
  • Cost segregation studies and engineering reports where applicable
  • Coordination with your attorney on contemporaneous board minutes, resolutions, and intercompany agreements
  • Bank, payroll, and accounting tie-outs reconciled to the filed return
  • A clean, indexed binder ready to hand to a reviewer on day one

Calm, not aggressive

Audits are routine. Defensibility is the point.

A notice or examination is not a crisis when the file is built correctly. It is a procedural conversation in which we respond on your behalf, using the same documentation we created when the strategy was implemented. No scramble, no surprises, no rebuilding a year of decisions from memory.

Frequently asked questions

Is audit protection an add-on I have to buy separately?

No. It is built into every engagement rather than sold as an add-on at checkout. The documentation and defense file are built while the strategy itself is built, not assembled after a notice arrives.

Who represents me if the IRS sends a notice?

You are represented by the same CPAs and Enrolled Agents who designed your architecture, not someone reading the file for the first time. They respond using the documentation already on file from when the strategy was implemented.

What is in the defense file?

The defense packet includes position memos citing the relevant statute and rulings, elections and filings, substantiation logs, reasonable compensation analysis, and other supporting records specific to your situation. Exactly what applies to you depends on the strategies in your plan.

Strategy that performs the same in a review as it does on paper.
